I. Introduction

Ziliak Law, LLC (“we” or “us”) is committed to maintaining the accuracy, confidentiality, and security of your personally identifiable information (“Personal Information”).  This privacy notice describes how and why we might collect, store, use and/or share (“process”) your Personal Information.  We are committed to ensuring that we process your Personal Information in accordance with applicable data protection laws, including, but not limited to, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), and the General Data Protection Regulation (EU) 2016/679 (the “GDPR”).  If you do not agree with our policies or practices, or you otherwise do not agree with this Privacy Policy, please do not use the website located at https://ziliak.com or https://ziliaklaw.com (collectively, the “Website”) or provide us with any Personal Information.

We may, at times, process additional categories of Personal Information which we receive from our clients during our legal representation of them.  However, such processing is subject to our client agreements and applicable professional responsibilities and is therefore not covered by this Privacy Policy.

II. Personal Information Collected

Depending on how you interact with the Website, we may collect the following Personal Information when you visit the Website or otherwise provide us with Personal Information in connection with the Website:

A) Personal Information provided when completing forms available on the Website;
B) Personal Information provided when contacting us; and
C) Details of visits to the Website, including the volume of traffic received, logs and the resources you have accessed during your visit, and the devices used to access such information.

The categories of Personal Information we may collect pursuant to this Privacy Policy include, but are not limited to:

A) Identifiers, such as name, contact details, mailing address, email address, phone number, and Internet Protocol address;
B) Commercial information, including information that could identify you and/or relates to the services or events in which you expressed interest; and
C) Internet or other electronic network activity information, such as information regarding your use of the Website, as well as information relayed to us using the forms available on the Website.

We will only use your Personal Information for the purposes for which we collected it, unless we reasonably consider it necessary to use it for a different reason compatible with the original purpose.  If use beyond the original purpose of collection occurs, we will notify you and explain the legal basis allowing us to do so.

III. How We Obtain Personal Information

In the course of operating the Website, we may obtain your Personal Information from:

A) Communications with us in connection with the Website or other services, including events and any updates to information provided by you;
B) Information captured by the Website in the course of your visit, including any information captured via cookies;
C) Information that you provide to us at the start of your engagement, or during the course of our providing services to you;
D) Information that you provide in conjunction with your application for employment; and
E) Information that we collect from publicly available sources, including information collected in an offline context.

We do not knowingly solicit data from or market to children under 18 years of age.  By using the Website, you represent that you are at least 18 years of age or that you are the parent or guardian of such a minor and consent to such minor’s use of the Website.  If you become aware of any data we may have collected from children under the age of 18, please contact us at info@ziliak.com.

IV. Our Personal Information Retention Criteria

The CCPA requires that we disclose the criteria we use to determine how long we will retain each category of Personal Information we collect.  Because our records often contain several categories of Personal Information combined together, we consider, on a case-by-case basis, a number of factors in assessing how long Personal Information is retained.  These factors include what Personal Information is necessary to (i) provide our services or administer our relationship with an individual; (ii) protect our business, employees, organization, and others; (iii) fulfill our various legal and regulatory obligations; and (iv) investigate and address issues as they arise, including, but not limited to, those related to safety, potential security incidents, and/or policy violations.

V. With Whom Personal Information is Shared

We neither sell nor rent any Personal Information collected to third parties.

We do not disclose any Personal Information about you to third parties, except (i) to third parties who perform services on our behalf (including vendors providing services related to the operation of the Website); (ii) as permitted by law or regulation pursuant to any legal process; (iii) in response to government, regulatory, law enforcement, or judicial inquiries; (iv) to our lawyers or other professional advisors; and (v) to entities whom we may transfer or merge part of our business or our assets in connection to a corporate transaction.  If such a change happens to our business, then the successor entity may use your Personal Information in a manner consistent with this Privacy Policy.

VI. Transfer of Personal Information Under the GDPR

The Personal Information we collect may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”) where a third party identified in Section V is located outside of the EEA.  Normally, any such transfer will be conducted on the basis of the model clauses approved by the European Commission for transfers from European Union (“EU”) controllers to non-EU controllers.  

VII. Links to Other Websites

We may, as appropriate, provide links to third-party websites.  Such websites are independently owned and therefore not under our control.  The privacy policies of such websites are not governed by this Privacy Policy.  We are not responsible for the content or privacy practices of such third-party websites, nor for the confidentiality, use, processing, and security of Personal Information that you may provide to such websites in the course of your visit.  

VIII. Your Privacy Rights

Based on your state of residence, you may have the rights listed below with respect to your Personal Information. These may include the right: (i) to request access and obtain a copy of your Personal Information; (ii) to require rectification or erasure; (iii) to restrict the processing of your Personal Information; and (iv) if applicable, to data portability.  

In certain circumstances, you may also have the right to object to the processing of your Personal Information.  You can make such a request by contacting us using the information provided in Section.

If you are located in the EEA or the United Kingdom, and you believe we are unlawfully processing your Personal Information, you also have the right to complain to your local data protection supervisory authority. IX. Cookies and Other Tracking Technology

We may use cookies or similar tracking technologies to access or store information.  Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Notice when you first visit the Website.  

Further, we use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help analyze how visitors use the Website and to improve the website services, communications, and user experience.  The information generated by the cookies about your use of the Website (including your IP address) will be transmitted to and stored by Google on servers controlled by Google in the United States or other jurisdictions selected by Google. Google will use this information for the purpose of evaluating your use of the Website, compiling reports on Website activity and providing other services relating to Website activity and internet usage. Google may also transfer this information to third parties where it is required to do so by law, or where such third parties process the information on Google's behalf or where Google is permitted to do so under its Privacy Policy. X. Notice to California Residents of Certain Rights Under the CCPA

The CCPA enables California residents to request and obtain from us, once a year and free of charge, information about categories of Personal Information (if any) that we disclosed to third parties for direct marketing purposes, and the names and addresses of all third parties with whomwe shared personal information in the immediately preceding calendar year.  If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

Furthermore, California residents have the right to request that we delete any of your Personal Information that we retain, subject to certain statutory exceptions, including, but not limited to, our compliance with U.S., state, local and non-U.S. laws, rules and regulations. We will notify you in writing and provide an explanation if we cannot comply with a specific request.

We will not discriminate against you for exercising your rights under the CCPA, including by denying service, by charging (or suggesting that we will charge) different rates for services or providing (or suggesting that we will provide) a different level or quality of service to you.
